Mandatory Labor Law Change for North Dakota as of August 2013

The North Dakota Department of Labor and Human Rights has updated their ND Minimum Wage & Work Conditions Summary posting. The definition of a “service employee” in regard to tip credit has been added, and the old minimum wage was deleted. If an employee separates from employment voluntarily, employers may now withhold payment for accrued paid time off if they informed the employee in writing of the limitation on paid time off at the time of hire, if an employee has been employed less than a year, and if the employee gave less than five days’ written or verbal notice. All three conditions must be met in order for the employer to be able to withhold payment for accrued paid time off. Additionally, new allowable deductions from wages have been added. This change affecting the ND Minimum Wage & Work Conditions Summary is in effect August 20th 2013.
