Mandatory Change to West Virginia’s Human Rights Act, Fair Housing Act, and Pregnant Workers’ Fairness Act Notice

The West Virginia Human Rights Commission updated the Human Rights Act, Fair Housing Act, and Pregnant Workers’ Fairness Act notice. Persons with disabilities who utilize assistance animals have been added as an additional category under the Fair Housing Act. There is a new provision for the Pregnant Workers’ Fairness Act which prohibits discrimination in employment based on pregnancy, childbirth, or related medical conditions.

Effective date: 4/18/2016

Recommended Changes to West Virginia’s Humans Right Act and Fair Housing Act and Parental Leave Notices

Human Right Act and Fair Housing Act

The West Virginia Human Rights Act and Fair Housing Act posting has been updated with a slightly new layout. The term “Handicap” has been replaced with “Disability.” A Toll Free number and Website URL has been added to the contacts section.

Parental Leave

The West Virginia Division of Labor updated their Parental Leave Act posting to reflect minor formatting changes. The term “Parental Leave” has been un-bolded. The West Virginia logo has also been updated.

Mandatory Change to West Virginia Wage and Payment Collection Act

The West Virginia Division of Labor has updated their Wage Payment and Collection Act posting. The posting now specifies that employees may now also be paid through direct deposit and must have a bank convenient to the place of employment for immediate access to wages. Additionally, information has been incorporated to explain that an employee is to be paid no more than 19 days between paydays. There are also now chapters, articles, and sections of the Code of West Virginia which have been added after every stated law on the posting. Finally, a wage and hour website for West Virginia residents has been added along with a new revision date of June 2015.

Mandatory Labor Law Change for West Virginia Unemployment Benefits

WORKFORCE West Virginia has updated their Notice to Employees on Unemployment Benefits revise the unemployment eligibility requirements. Employees may now use an alternate base period (consisting of the last four quarters immediately preceding the first day of the individual’s benefit year) if so desired to qualify for unemployment benefits. Additionally, a new 2013 revision date has been added.
