Recommended Changes to Hawaii’s Breastfeeding in the Workplace, Whistleblower Protection Law, Disability Compensation Law, Discrimination, Occupational Safety and Health Laws, Unemployment Insurance Law, and Wage and Hour Laws Notices

Breastfeeding in the Workplace:

The Hawaii Department of Labor and Industrial Division updated the Breastfeeding in the Workplace posting. New text has been added to the bottom of the posting which states that the department is an Equal Opportunity Employer/Program and that auxiliary aids and services are available upon request to individuals with disabilities. A revision date has also been added.

Whistleblower Protection Law:

The Hawaii Department of Labor and Industrial Division updated the Whistleblower Protection Law posting. New text has been added to the bottom of the posting which states that the department is an Equal Opportunity Employer/Program and that auxiliary aids and services are available upon request to individuals with disabilities. A revision date has also been added.

Disability Compensation Law:

The Hawaii Department of Labor and Industrial Division updated the Disability Compensation Law posting. New text has been added to the bottom of the posting which states that the department is an Equal Opportunity Employer/Program and that auxiliary aids and services are available upon request to individuals with disabilities. A revision date has also been added.

Discrimination:

The Hawaii Department of Labor and Industrial Division updated the Discrimination posting. New text has been added to the bottom of the posting which states that the department is an Equal Opportunity Employer/Program and that auxiliary aids and services are available upon request to individuals with disabilities. The revision date has also been updated.

Occupational Safety and Health Laws:

The Hawaii Department of Labor and Industrial Division updated the Occupational Safety and Health Law posting. “Employees working on military installations” is no longer listed as an exception to the occupational safety and health regulations. New text has been added to the bottom of the posting which states that the department is an Equal Opportunity Employer/Program and that auxiliary aids and services are available upon request to individuals with disabilities. A revision date has also been added.

Unemployment Insurance Law:

The Hawaii Department of Labor and Industrial Division updated the Unemployment Insurance Law posting. New information has been added under the “Important Information” clause which states that if benefits are payable, claimants must receive payments by direct deposit and information on the account type, financial institution routing number, and account number must be provided. New text has also been added to the bottom of the posting which states that the department is an Equal Opportunity Employer/Program and that auxiliary aids and services are available upon request to individuals with disabilities. The revision date has also been updated.

Wage and Hour Laws:

The Hawaii Department of Labor and Industrial Division updated the Wage and Hour Law posting. New text has been added to the bottom of the posting which states that the department is an Equal Opportunity Employer/Program and that auxiliary aids and services are available upon request to individuals with disabilities. A revision date has also been added.

Whistleblower Protection Law

The Hawaii Department of Labor and Industrial Relations has updated their Whistleblower Protection Law posting. Changes include the addition of the new Director of the Hawaii Department of Labor and Industrial Relations, Linda Chu Takayama. The website to receive information about the posting requirements of the Whistleblower Law has also been updated.

The Hawaii Department of Labor and Industrial Relations has updated their Military Leave posting. Changes include the addition of the new Director of the Hawaii Department of Labor and Industrial Relations, Linda Chu Takayama. The website to receive information about the posting requirements of the Military Leave Law has also been updated.

Mandatory Labor Law Change for Hawaii as of July 2013

Update your Hawaii Labor Law Posters. The required posting has changed.

Under the Hawaii Employment Practices Law, a new posting is required for all Hawaii businesses regarding the right of mothers to breastfeed in the workplace. A breastfeeding mother now has the right to reasonable break time to express milk for a child in a private location (other than a restroom) for up to one year after the birth of the child. This law applies to employers of 20 or more employees. Violators of this law will be charged $500 per violation, and may be liable for damages caused to the employee. This change affecting the Hawaii Employment Practices Law is in effect as of July 2013.
