Mandatory Change to Georgia’s Bill of Rights for Injured Workers

Bill of Rights for Injured Workers:

The Georgia State Board of Workers’ Compensation has updated the Bill of Rights for the Injured Worker notice. All injuries occurring on or before June 30, 2013 shall now be entitled to lifetime medical benefits. If an accident occurred on or after July 1, 2013, then medical treatment shall be limited to a maximum of 400 weeks from the accident date. If the injury is catastrophic, the injured worker may now be entitled to lifetime medical benefits. Additionally, catastrophic and non-catastrophic injuries are now entitled to not exceed $575 per week for a job related death or injury. Weekly income benefits will now be no more than $383 per week, not exceeding 350 weeks if it is determined that the injured employee may work and chooses not to or if the employee is only able to get a lower income job due to the injury. Dependents, in the event the worker dies due to a job-related injury will receive no more than $575 of weekly benefits while a widowed spouse with no children will receive a paid maximum of $230,000. Lastly, the notice has an updated revision date of 7/2016.

Mandatory Change For Georgia’s Workers’ Compensation Bill of Rights Posting

The Georgia State Board of Workers’ Compensation has updated their Workers’ Compensation Bill of Rights poster. The posting now  specifies that compensation for catastrophic and non-catastrophic injuries at work is now not to exceed $550 per week for a job-related death or injury for as long as the injured employee is unable to return to work. Additionally, the weekly income benefits will now be no more than $367 per week, not exceeding 350 weeks if it is determined that the injured employee may work and chooses not. This is also applied  if the employee is only able to get a lower income job due to the injury. Along with a this, a widowed spouse, due to a job related injury with no children, will be paid a maximum of $220,000. Finally, the posting has a new optional Lawyer Referral Service and an updated revision date of July 2015.

Mandatory Labor Law Change for Georgia Workers Compensation

The Georgia State Board of Workers’ Compensation has updated their Bill of Rights for the Injured Worker posting to reflect the increase in payable Workers Compensation benefits. Workers may now receive up to $525 per week for a job-related injury. If the worker can return to work but only get a lower paying job as a result of a work-related injury, he or she is now entitled to receive up to $350 per week.  If a worker dies as a result of an on-the-job accident, dependent(s) can now be paid up to $525 a week. Additionally, a new July 2013 revision date has been added to the posting.

Georgia peanut processor cited for 41 OSHA violations

 The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) is proposing 41 safety and health violations against Birdsong Corporation’s facilities in Sylvester and Blakely, Ga.

“Our inspections, and a worker fatality at the Blakely plant, show the need for management to get serious about the safety and health of its employees,” said Robert Vazzi, OSHA’s area director in Savannah.

OSHA began an inspection of Birdsong’s Sylvester plant in June 2009. Compliance officers found 21 serious safety violations and one other-than-serious safety violation, including lack of machine guards, fall hazards, electrical hazards, a lack of emergency lighting and unmarked exit doors. In July 2009, a separate inspection was opened to address possible noise hazards at the plant, resulting in three serious and one other-than-serious health violations.
