Health and Safety Protection on the Job

The Wyoming Department of Workforce Services has updated the Health and Safety Protection on the Job notice. Penalties for serious violations and optional penalties for non-serious violations are now $12,471. Additionally, any employer who willfully and knowingly violates the Wyoming Occupational Health and Safety Act, upon conviction, is to be assessed penalties of not more than $124,709 for each violation. Lastly, employers must post OSHA citations at or near the place of the alleged violations for a minimum of 3 days or until all citations are abated.

New Mandatory Pregnancy Accomodation Notice for Utah

Pregnancy and Related Conditions

The Utah Labor Commission has released a new Pregnancy and Related Conditions notice. Under the Utah Antidiscrimination Act, employers are required to make reasonable accommodations for an employee for pregnancy, child birth, breastfeeding, or a related condition, upon the employees request. An employer cannot require and employee to end the employment if a reasonable accommodation may be given, or deny employment opportunities to the employee if the denial is based on the need to make a reasonable accommodation unless the employer can show that the reasonable accommodation is an undue hardship. Employers may require an employee seeking reasonable accommodation to provide a medical certification. Employers may not require an employee to obtain a certification from the employee’s health care provider for more frequent restroom, food, or water breaks. Lastly, a phone number and email address have been provided on the notice to receive more information.

Mandatory Change to New Jersey’s Family Leave Act

Family Leave Act

The New Jersey Office of the Attorney General has updated the Family Leave Act Notice. Family Leave Act regulations are now applicable to government entities regardless of the number of employees. Additionally, leave may now be taken for a step-parent or parent-in-law. The notice is newly formatted with a revision date of 9-6-2016.

Recommended Changes to San Diego’s Minimum Wage and Earned Sick Leave Notices

Earned Sick Leave

The City of San Diego has updated their Earned Sick Leave notice. Employers must provide employees no less than 40 hours of earned sick leave at the beginning of each benefit year. Additionally, employers may cap employee’s total accrual of earned sick leave at 80 hours. Lastly, the notice now includes a new email address to contact the City of San Diego’s Minimum Wage Program and an updated revision date of September 2016.

Recommended Change to Ohio’s Unemployment Insurance Notice

Unemployment Insurance

The Ohio Department of Job and Family Services has updated the Unemployment Insurance notice. Formerly known as Unemployment Compensation, the updated notice has changed the name from the center for unemployment to “OhioMeansJobs Center.”
